The practical rules for using PVspark websites, accounts, product features, and materials.

Agreement and scope

These terms apply when you visit pvspark.com, submit a form, or use a PVspark account or service. “PVspark”, “we”, and “us” mean the operator of those services. By using a service, you agree to these terms. If you do not agree, do not use it.

A signed order form, service agreement, trial agreement, or other written terms may also apply to product access. That agreement identifies the contracting provider, commercial scope, fees, support commitments, and any negotiated terms. If it conflicts with these terms, the signed agreement controls for that customer and service.

Eligibility and authority

You must be at least 18 and legally able to enter this agreement. If you use PVspark for a company or other organization, you confirm that you are authorized to accept these terms and act for that organization. Product access is intended for business and professional use.

Accounts and access

A public enquiry or demonstration request does not create an account or guarantee product access. Access may require an invitation, verified email, authentication controls, an active customer relationship, and acceptance of additional terms.

You must provide accurate account information, keep credentials and authentication devices secure, use only your own authorized account, and promptly report suspected misuse to security@pvspark.com. Your organization controls its members, roles, project access, and the data its users submit.

Permitted use

Subject to these terms and any customer agreement, PVspark grants authorized users a limited, non-exclusive, non-transferable right to access the service for the organization’s internal solar-project work during the authorized period.

You must not:

  • use the service unlawfully, deceptively, or to infringe another person’s rights;
  • access another organization’s data or account without authorization;
  • circumvent access, usage, security, or technical controls;
  • introduce malware, disrupt the service, or probe it without written permission;
  • scrape, resell, sublicense, or commercially exploit the service except as a signed agreement expressly allows; or
  • reverse engineer or attempt to extract source code except where applicable law does not permit that restriction.

Your data and responsibilities

You and your organization retain your rights in data you submit. You give PVspark and its service providers the rights needed to host, process, transmit, back up, and present that data solely to operate, secure, support, and improve the contracted service and meet legal obligations.

You are responsible for the accuracy, legality, and quality of submitted data; for having the permissions and notices needed to use personal, site, equipment, tariff, and customer information; and for reviewing outputs before relying on them. Do not upload content you are not entitled to use or unnecessary sensitive information.

The privacy notice explains how PVspark handles personal data. A customer agreement may include further processing, confidentiality, retention, export, and deletion commitments.

Professional and product boundaries

PVspark assists solar professionals with structured project workflows, calculations, analysis, and reviewable outputs. It does not replace site inspection, engineering judgment, manufacturer instructions, licensed professional review, legal or tax advice, utility approval, or compliance with applicable codes and regulations.

Maps, imagery, weather, tariffs, equipment information, prices, calculations, generated assistance, and third-party data may be incomplete, delayed, unavailable, or dependent on assumptions. You are responsible for validating inputs and outputs for the specific site and decision. PVspark does not guarantee site conditions, code compliance, equipment suitability, energy production, financial performance, savings, approval, or project outcomes.

Third-party services

PVspark may interoperate with mapping, solar-data, identity, communications, payment, cloud, or customer-selected services. Their availability and data can change, and their own terms may apply. PVspark is not responsible for third-party products outside its control, but this does not limit responsibility that applicable law does not allow us to exclude.

Ownership and feedback

PVspark and its licensors retain all rights in the service, software, designs, documentation, trademarks, and materials other than your data. No rights are granted except those expressly stated. If you voluntarily provide suggestions, you permit us to use them without restriction or payment, provided we do not publicly identify you without permission.

Fees, availability, and changes

Any fees, taxes, billing cycle, renewal, cancellation, refund, usage allowance, service level, or support commitment applies only when stated in the relevant order form or customer agreement. We may improve, replace, or discontinue website content or product features. We will give notice required by an applicable agreement or law when a material change affects active paid access.

Suspension and termination

We may restrict or suspend access where reasonably necessary to address a security risk, unlawful or abusive use, non-payment under an applicable agreement, material breach, or harm to the service or another user. We may terminate access as an applicable agreement permits. Provisions that by their nature should survive, including ownership, payment obligations, disclaimers, liability limits, and dispute terms, continue after termination.

Disclaimers

To the fullest extent permitted by law, the public website and any free or evaluation access are provided “as is” and “as available”. We do not promise that they will be uninterrupted, error-free, or suitable for every purpose. Any express warranty or service commitment in a signed customer agreement controls for that service. Nothing in these terms excludes a statutory guarantee or other right that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, PVspark and its personnel will not be liable under these terms for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profit, revenue, goodwill, or data. Any liability cap in a signed customer agreement controls. For use without a separate customer agreement, PVspark’s aggregate liability arising from the service will not exceed the amount you paid PVspark for that service during the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, wilful misconduct, or liability that applicable law does not permit to be excluded or limited.

Governing law and general terms

These terms are governed by the laws of India, without limiting mandatory rights that apply to you. A signed customer agreement may specify a dispute process or court. Otherwise, disputes may be brought before a court of competent jurisdiction in India.

If part of these terms is unenforceable, the rest remains in effect. A delay in enforcing a right is not a waiver. You may not assign these terms without our written consent; we may assign them as part of a reorganization, financing, or transfer of the relevant service. Neither party is responsible for delay caused by events outside its reasonable control, except for payment obligations.

Changes and contact

We may update these terms as the service or law changes. The revised version and effective date will appear here. Material changes will apply prospectively, with additional notice where required. Questions about these terms can be sent to hello@pvspark.com.
